Welcome to ClearDNS. These Terms of Service ("Terms") govern your use of the ClearDNS DNS filtering service ("Service") operated by ClearDNS ("we," "us," or "our"). By using our Service, you agree to these Terms.

1. Service Description

ClearDNS provides DNS resolution and filtering services that help protect your devices from unwanted content, advertisements, tracking, and malicious domains. Our Service includes:

• DNS resolution with configurable content filtering
• Protection against malware, phishing, and malicious domains
• Ad and tracker blocking capabilities
• Optional parental control features
• Encrypted DNS (DoH/DoT) for privacy

2. Acceptance of Terms

By configuring your device to use ClearDNS servers, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

3. No Account Required

ClearDNS is designed to work without user accounts. You can use our Service without providing any personal information. Device configurations are managed through anonymous tokens that do not identify you personally.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You shall not:

• Use the Service to engage in any illegal activity
• Attempt to circumvent, disable, or interfere with the Service's security features
• Use the Service in any manner that could damage, disable, or impair our servers or networks
• Attempt to gain unauthorized access to any portion of the Service
• Use automated means to send excessive DNS queries intended to overload our systems
• Resell or redistribute the Service without our written permission
• Use the Service to intercept or monitor communications of others without authorization

5. Service Tiers

ClearDNS offers different service tiers:

• Free Tier: Basic DNS filtering with standard features, subject to usage limits
• Paid Tiers: Enhanced features, higher limits, and additional capabilities as described on our website

We reserve the right to modify tier features and pricing with reasonable notice. Paid subscriptions are governed by additional payment terms provided at the time of purchase.

6. Service Availability

We strive to provide reliable DNS resolution with high availability. However, we do not guarantee uninterrupted service. The Service is provided "as is" and "as available." We may:

• Perform maintenance that temporarily affects availability
• Experience outages due to factors beyond our control
• Modify or discontinue features with reasonable notice

7. Content Filtering Accuracy

While we strive for accurate content categorization and filtering:

• No filtering system is 100% accurate
• Some legitimate content may occasionally be blocked (false positives)
• Some undesirable content may occasionally pass through (false negatives)
• Filter lists are regularly updated but may not cover all threats immediately

We are not responsible for content that is incorrectly categorized or for any damages resulting from filtering decisions.

8. Intellectual Property

The Service, including its design, features, and documentation, is owned by ClearDNS and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

9. Third-Party Services

Our Service utilizes third-party infrastructure providers (including Cloudflare) for DNS resolution and content delivery. Your use of our Service is also subject to these providers' terms of service and acceptable use policies.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

• The Service will meet your specific requirements
• The Service will be uninterrupted, timely, secure, or error-free
• The filtering will be 100% accurate
• Any errors in the Service will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEARDNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers
• Any content or data transmitted or received through the Service
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or similar harmful code that may be transmitted through the Service

12. Indemnification

You agree to indemnify and hold harmless ClearDNS, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

You may stop using the Service at any time by removing the ClearDNS configuration from your devices.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will post the updated Terms on our website with a new "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ClearDNS operates, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be addressed through good-faith negotiations. If a dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with applicable arbitration rules.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ClearDNS regarding your use of the Service and supersede any prior agreements.
